60. How can I sue the monkeys?

Outline:

Irwin Schiff often points out that the IRS has no more authority to collect income tax than a set of monkeys with tin cups - hence the allusion to our simian friends!

We can sue the IRS at almost any stage, after "administrative remedies" have been exhausted. One reason might be to recover seized assets, but that will not arise if proper precautions have been taken as shown here. More commonly, we can take the offensive by trying to make them stay within their legal bounds:

Suits cost some money to file and prepare, so Zedheads should be aware that they cannot be expected to succeed. One day they may - what a victory that will be! - but the main aim is to build a record of the long catalog of judicial corruption, and to harass the enemy so that he pursues softer targets and leaves us in peace.

The Basic Tool Set is needed for a proper understanding of this as of all questions indexed here.

The Federal Mafia details some of Mr Schiff's early attempts to sue the government, in Chapters 7 and 10 and the Epilog. While our strategy has been much refined since those early days, this is priceless material for demonstrating the deep corruption and bias that we face, in the Judicial branch of the Federal Mafia - and therefore, an invaluable preparation.

Audiotape Series 3 in Tape 1 discusses Mr Schiff's suit against three judges, and Tapes 2 and 6 and Exhibit A show how to file suit for a refund of tax improperly with-held, in the event one's Zero Return claiming such a refund is not honored - including how to use the important "discovery" pre-trial procedure. Tape 6 reports one of our few successes; a Zedhead sued and won an $8,000 refund.

Audiotape Series 4 in Tape 5 reports the successful suit filed by Peggy Williams, for recovery of money unlawfully seized by the IRS from her bank account; and includes an improved pro-forma lawsuit for recovery of pay wrongly with-held.

Audiotape Series 5 in Tape 1 introduces a new pro-forma lawsuit with a Memorandum of Law, to obtain refunds when the IRS fails to honor a Zero 1040 - provided as Exhibits 3 and 4 - and discusses how one should prepare for any lawsuit by reading a book on civil litigation and possibly hiring a paralegal. Tape 5 notes that we don't have to win every such suit, for the "ballgame will be over" for the IRS when even one of them is won. Tape 5 also discusses the Brown case that Irwin brought, with Exhibit 6 showing some of its detail, and which subsequently appealed to the US Supreme Court (which denied certiori.)

Audiotape Series 6 in Tape 2 updates Mr Schiff's advice on suing pursuant to a government failure to refund money following filing of zero 1040Xs. Tape 5 details how to sue under 26 USC 7433 for damages following IRS extortion - which includes intervention to prevent full payment of wages following an Exempt W-4 filing. Tape 5 also gives the latest news about Mr Schiff's case of US v Brown, which he escalated to the Supreme Court.
