70. Can I avoid State i-tax too?

Outline:

Forty-four States purport to tax what their residents earn, and forty-two of those do so by "piggybacking" the Federal system; their laws attempt to copy-in the Federal definitions, and their filing instructions direct the filer to copy to the State form certain data that was written on the Federal form (1040.) In those 42, the answer is certainly YES; for only a "zero" can be copied, and so the State tax liability is zero.

They may not like that, but they are hoist on their own petard.

The other two States (NJ and PA) have somewhat independent laws, and need to be dealt with accordingly. There is a set of messages on t-f-n to address the conditions applying there.

Mr Schiff is unable to offer specific advice state-by-state, so the Zedhead's primary resource in any taxing State is t-f-n.

Audiotape Series 4 Tape 2 explains how to file a State Zero Return, and Tape 4 Side 1 shows how to use State tax codes with our "Show me the Law!" strategy. And Tape 6 relates the story of how Nevada tried to close down Mr Schiff's Freedom Books firm by harassing it for sales tax! - one sign of how desperate they are.

Audiotape Series 6 Tape 2 has an extensive "worked example" of how to handle State i-tax issues, using the case of California. Don't face your State without it! Then Tape 6 adds advice about facing State tax people in the context of a Hearing - how to use the fact that they nearly all "piggyback" Federal i-tax to embarrass them, on the record, not with arguments or statements but with questions they cannot answer; we can trap them!

Some States have their own Yahoo! Group, and as these are being created regularly it's worth performing a "Search Archive" for the phrase "TFN-Yourstate" to find posts that introduce them.

Next best idea: "Search Archive" for posts containing just the name of your State. There is a very large number of posts about specific states, and the list below is just a small, recent sample.
